Recently, our southern neighbors released updates regarding which Ukrainians can extend their stay in the U.S. for an additional 18 months under the Temporary Protected Status (TPS) program. One of the fundamental requirements is continuous residence in the U.S. since August 16, 2023, or earlier.
What does "continuous" mean? It means no trips back to Ukraine, Europe, or even vacations abroad.
Canada, in this case, has (or had) a more lenient approach. However, with the resignation of the current prime minister (or former one now), and the shift in power across federal and provincial levels to conservative leadership, Canada could easily adopt a similar policy, potentially retroactively.
A few key warnings from me:
- CUAET open work permits can be extended until March 31, 2025.
- Extensions can ONLY be applied for while you are in Canada‼️ IRCC has an agreement with border services, and all travel movements are visible to IRCC.
- If you apply for an extension from outside Canada, this absence will also be visible in the system, and your extension may not be granted.
- If you have applied for an extension and left Canada, this is legal. However, ensure that you have a valid visa, as the work permit alone does not grant you the right to re-enter Canada.
- If you do not have a visa, after obtaining your extended work permit, you will need to separately apply for a visa through the Canadian Embassy in the country where you are staying.
