PR for undocumented workers? It’s not as simple as it seems

It is important to address the government's initiative to grant PR to workers who gained experience in Canada while being undocumented. This is a very sensitive topic, raising moral questions like, “Why did I go through all the trouble of maintaining my status while someone else went into hiding and still gets PR?” But the reality is much more complicated.

First, this program is specifically designed for Toronto and nearby cities. It is not the first program for the legalization of construction workers. The initial program launched in 2019, was repeatedly extended, and finally closed in December 2024.

There are quotas! Typically, the program allowed 500 applicants per year, increasing to 1,000 in 2023 and 2024. As of now, the plan is to accept 6,000 applicants.

The program has strict requirements:

  • Applicants must have entered Canada LEGALLY. (Those who entered illegally are not eligible.)
  • Must have lived continuously in Canada for at least 5 years.
  • Must have at least three years of construction work experience in the last five years.
  • Must work in NOC categories 72-73 (which are skilled trades).
  • Must have at least CLB 4 in all language categories.
  • Must have a relative in Canada with PR or citizenship (including aunts, uncles, and all first cousins).
  • Must obtain a support letter from the Canadian Labour Congress (CLC).
  • Must have no legal issues other than expired status.

The exact requirements for this year’s intake are not yet announced, but most of the criteria will likely remain unchanged.
